These terms and conditions are designed to protect both you (the client) and Presence Foundry, the service provider. By engaging in our services or using our website you agree to the following terms
All services provided by Presence Foundry are for exclusive use of the client unless otherwise agreed. Upon full payment of all project-related fees:
Ownership of the final website or application files, excluding raw design/source files, transfers to the client upon completion and final payment. Presence Foundry retains the rights to display work for promotional purposes unless otherwise agreed.
Access to source files (e.g Figma, Adobe, Webflow working files, Unity source files) is not included unless explicitly stated or negotiated.
We may work with third-party developers, illustrators or specialists where needed. All third-party contributions will be licensed appropriately. Any additional costs will be approved with the cleint before work is carried out.
Communication is typically handled via email, phone or video meeting. Standard response times are Monday-Friday, 11AM-5PM GMT. Contact outside of those hours is welcome, but not guaranteed to receive an immediate reply.
A 50% non-refundable deposit is required before work begins. The remaining is due upon completion, or after 6 weeks - which ever comes first. Deliverables will only be released once full payment is recieved.
All recuring services must be paid in advance. Late or missed payments may result in temporary service suspension.
Once the deposit is paid, the client is deemed to have accepted these Terms & Conditions.
Additional changes beyond the agreed scope or revision limit will be billed accordingly. Work begins once additional cost are approved in writing or via email confirmation.
If payment is not received within 30 days of invoicing, Presence Foundry reserves the right to:
If the client goes silent (no replies via email/phone) for more than 90 days, the project may be cancelled by Presence Foundry. Work completed up to that point will be billed.
Clients on retainer can cancel with one month's notice after the initial 3-month period. We reserve the same right.
Presence Foundry reserves the right to showcase completed work for promotional purposes (website, portfolio, social media, etc.) unless otherwise agreed in writing.
If any information provided by the client is confidential, it must be declared in writing before the project begins.
The client agrees to indemnify and hold harmless Presence Foundry from legal claims resulting from content or materials provided by the client.
Design projects include up to 3 round of revisions during each phase. Additional changes will be billed at the standard hourly rate.
Presence Foundry is currently a sole trader business based in the United Kingdom
